Terms of Service
Terms of Service for SuperSend TX, a transactional email API and dashboard.

1. The Service
SuperSend TX provides transactional email infrastructure: REST API, SDKs, dashboard, domain verification, webhooks, templates, suppressions, inbound routing, and related features (the "Service").
SuperSend TX is for transactional and relational email (for example receipts, password resets, alerts, and product notifications). It is not a cold outbound, marketing blast, or LinkedIn automation product.
You are responsible for all activity under your account and for ensuring your use complies with applicable laws, including CAN-SPAM, GDPR, PECR, CASL, and similar anti-spam and data protection laws.
2. Plans, Billing & Payments
The Service is offered on Sandbox (free), Pool (paid), and Dedicated (paid) plans, as described on our pricing page. Pool is available self-serve. Dedicated capacity may require coordination with our team.
Paid plans are billed in advance through Stripe and auto-renew unless you cancel before renewal. You authorize us to charge applicable fees, taxes, and metered overage.
Fees are based on the plan you select and usage beyond included volume. Payment processing is handled by Stripe.
3. Cancellation
You may cancel paid plans from your billing settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds or credits for partial periods except where required by law.
4. Acceptable Use
Your use of the Service must comply with our Acceptable Use Policy. We may suspend or terminate accounts that harm deliverability, violate law, or abuse shared infrastructure.
You agree not to use the Service for unlawful purposes, unsolicited bulk email, phishing, malware, or to circumvent technical limits, rate limits, or plan caps.
5. Customer Data & Privacy
You are the controller of personal data in message content, recipient lists, and related customer data you upload or send through the Service.
SuperSend TX acts as a processor for Customer Personal Data processed on your behalf to deliver email and operate the Service. Processing is described in our Privacy Policy. For enterprise or EU/UK processing needs, contact us for a Data Processing Agreement.
6. Shared Infrastructure & Deliverability
Pool and Sandbox traffic may share transactional sending infrastructure with other paying customers. We do not guarantee specific inbox placement, delivery rates, or third-party mailbox provider behavior.
We may throttle, queue, suspend, or terminate sending that risks shared reputation, violates policy, or exceeds plan limits.
7. Intellectual Property & Feedback
The Service, including software, designs, and documentation, is owned by SuperSend and its licensors. We grant you a non-exclusive, non-transferable, revocable license to use the Service during your subscription or authorized trial use.
If you submit feedback or suggestions, you grant SuperSend a royalty-free, worldwide license to use that feedback to improve the Service without obligation to you.
8. Disclaimers
The Service is provided "as is" and "as available." SuperSend disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
SuperSend does not warrant uninterrupted availability, specific deliverability outcomes, or compatibility with third-party platforms.
9. Limitation of Liability
To the maximum extent permitted by law, SuperSend will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenue, or data.
SuperSend's aggregate liability for all claims relating to the Service will not exceed the amounts paid by you to SuperSend for the Service in the twelve (12) months preceding the event giving rise to liability. Nothing limits liability for willful misconduct or where prohibited by law.
10. Termination & Suspension
We may suspend or terminate your access immediately for material breach, unlawful activity, abuse, or risks to platform integrity.
Upon termination, your right to use the Service ceases. Sections intended to survive (including intellectual property, disclaimers, limitations, and governing law) survive termination.
11. Governing Law & Disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles.
Exclusive jurisdiction and venue lie in the state or federal courts located in Delaware, and you consent to their jurisdiction.
12. Changes to Terms
We may update these Terms from time to time. Material changes will be notified via email or in-product notice. Continued use after the effective date constitutes acceptance.
